Law Enforcement & Subpoenas

1. Scope, Purpose & Jurisdiction

These guidelines outline the policies and procedures of Natrium Technologies Inc. regarding legal process, judicial discovery orders, warrants, and subpoenas served by law enforcement agencies, judicial authorities, and civil litigants.

2. Architectural Inability to Decrypt User Communications

Natrium operates under strict client-side zero-knowledge architecture. All message bodies, attachments, calendar notes, and drafts are encrypted on the user's local device with private cryptographic keys never known to or possessed by Natrium.

Formal Technical Inability Statement: Natrium does not possess, escrow, generate, or hold user private decryption keys. Consequently, Natrium cannot and does not provide plaintext message contents, unencrypted attachments, or decrypted data in response to subpoenas, court orders, warrants, or civil discovery requests. We have zero knowledge and zero technical capability to decrypt user data under any circumstance.

4. Statutory Legal Process Requirements

Natrium requires valid legal process prior to producing any available non-content subscriber records:

  • Subpoenas (18 U.S.C. § 2703(c)(2)): Valid federal or state grand jury or trial subpoenas are required for basic subscriber registration identity records.
  • Court Orders (18 U.S.C. § 2703(d)): Specific and articulable facts showing reasonable grounds to believe records are relevant and material to an ongoing criminal investigation.
  • Search Warrants (Rule 41 / State Law): Issued by a neutral magistrate upon a showing of probable cause.
  • International Agencies: Foreign law enforcement agencies must submit requests through formal Mutual Legal Assistance Treaty (MLAT) channels or letters rogatory through the U.S. Department of Justice.

5. Emergency Requests Involving Imminent Danger

Pursuant to 18 U.S.C. § 2702(b)(8) and 2702(c)(4), Natrium may disclose available records if we have a good faith belief that an emergency involving danger of death or serious physical injury requires immediate disclosure. Emergency requests must include details of the emergency and official law enforcement credentials.

6. User Notice Policy

It is Natrium's policy to notify affected tenants of legal requests for their records before disclosure, providing an opportunity to seek protective judicial relief, unless prohibited by a valid court order issued under 18 U.S.C. § 2705(b) or applicable statutory sealing orders.

All legal process and official law enforcement communications must be submitted via verified email or formal delivery to:
